Η Πορτοκάλι Ν.Ε. περιορίζει την ευθύνη της, εφόσον είναι εφαρμοστέο, με βάση τις παρακάτω Συμφωνίες και Κανονισμούς. Σε κάθε περίπτωση, η Πορτοκάλι Ν.Ε. δεν φέρει ευθύνη για οποιαδήποτε απόδοση που:
α) αποδίδεται στο λάθος των επιβατών.
β) αποδίδεται σε μη προβλέψιμη ή αναπόφευκτη πράξη ή παράλειψη τρίτου που δεν σχετίζεται με την παροχή οποιασδήποτε υπηρεσίας που προσφέρεται από τους άμεσους υπαλλήλους της.
γ) αποδίδεται σε ασυνήθιστη ή μη προβλέψιμη κατάσταση εκτός ελέγχου της Πορτοκάλι Ν.Ε., οι συνέπειες της οποίας δεν θα μπορούσαν να αποφευχθούν, ακόμη κι αν είχε ασκηθεί κάθε λογική προσοχή, συμπεριλαμβανομένου (αλλά όχι περιορισμένου σε) περιστατικά υπερίσχυσης ανωτέρας βίας.
δ) αποδίδεται σε περιστατικό το οποίο η Πορτοκάλι Ν.Ε. δεν θα μπορούσε να προβλέψει ή να αποτρέψει, ακόμη και αν είχε ασκηθεί κάθε δυνατή προσοχή.
Στην περίπτωση που ο επιβάτης χάσει το πλοίο σε οποιοδήποτε από τους λιμένες επί των οποίων αναγράφονται στο πρόγραμμα του κρουαζιέρας, η Εταιρεία ή το πλοίο δεν φέρει καμία ευθύνη ούτε αναμένεται να παρέχει εναλλακτική μεταφορά.
Ο συμβατικός συμφωνητικός κώδικας υπόκειται στο ελληνικό δίκαιο. Κάθε διαφωνία που αφορά την εκτέλεσή του υπόκειται στην αποκλειστική δικαιοδοσία των δικαστηρίων της Ελλάδας.
Οι επιβάτες αναλαμβάνουν την ευθύνη να αποζημιώσουν την εταιρεία ιδιοκτησίας για τυχόν ζημίες που η ιδιοκτήτρια εταιρεία ή οι αντιπρόσωποί της μπορεί να υποστούν, αποτέλεσμα των εκδρομών που πραγματοποιούνται εκ μέρους τους.
Οι επιβάτες πρέπει να τηρούν τους κανονισμούς ασφαλείας του αρχηγού του πλοίου και τους κανόνες σχετικά με την τάξη και την ασφάλεια στο πλοίο.
Στην περίπτωση ακύρωσης λόγω ακραίων καιρικών συνθηκών ή υπερίσχυσης ανωτέρας βίας, ολόκληρο το ποσό θα επιστραφεί σε όλους τους επιβάτες που έχουν καταβάλει τα σχετικά ταξίδι.
Portokali Cruises limits its liability, where applicable, by the Agreements and Regulations set out below. In any case, Portokali Cruises is not responsible for any performance that:
a) attributed to the fault of the passengers.
b) attributed to an unforeseeable or unavoidable act or omission of a third party that is not related to the provision of any services to be provided by its direct employees.
c) is attributable to an unusual or unforeseeable circumstance beyond the control of Portokali Cruises, the consequences of which could not have been avoided even if all due care had been exercised, including (but not limited to) an event of force majeure.
d) attributed to an event which Portokali Cruises could not even with all due care have foreseen or prevented.
In the event that the Passenger misses the ship at any of the ports of call listed on the cruise itinerary, the Carrier is under no circumstances responsible nor expected to provide alternative transportation.
The transit contract is subject to Greek law. Any dispute regarding its execution is reserved to the exclusive jurisdiction of the courts of Greece.
The Passengers undertake the responsibility to compensate the owner company for any damages that the owner or its representatives may suffer, resulting from the excursions made on their behalf.
Passengers must follow the ship’s Master’s safety regulations and rules regarding order and safety on board.
In the event of cancellation due to extreme weather conditions or force majeure, the full amount will be refunded to all passengers who have paid the fares in question.
Due to extreme weather conditions on some days it may not be possible to visit one of the predetermined cruise islands in which case there is no refund.
If you realize that you have forgotten an item, please contact the ship or the company immediately and describe the item.
In case of theft or loss of items the Ship or the company bears no responsibility.
